Terms & Conditions (PetCareAI LTD)

These Terms & Conditions (“Terms”) apply to purchases, subscriptions, free trials, and services offered via our website and related platforms (the “Site”).
The Site is operated by PetCareAI LTD, a company incorporated in the United Kingdom (“we”, “us”, “our”).

By accessing the Site, placing an order, purchasing a product, or subscribing to any service, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Introduction & Scope
1.1 About us

PetCareAI LTD provides:

Physical products (e.g., pet-related items where applicable) and/or

Digital services, including Animalia Chat, an AI-powered pet assistance service (“Service”).

1.2 Contract formation

A legally binding contract is formed when:

You place an order or subscribe through the Site, and

We confirm acceptance (e.g., order confirmation email, subscription confirmation, or access provisioning).

We may refuse or cancel an order if required by law, if there is a pricing/stock error, if fraud is suspected, or if the Service cannot be provided for technical or compliance reasons.

1.3 Changes to these Terms

We may update these Terms from time to time. The version displayed on the Site at the time of purchase/subscription will apply to that transaction. If changes materially affect an ongoing subscription, we will take reasonable steps to notify you.

2. Eligibility
2.1 Minimum age

You must be at least 18 years old to purchase products or subscribe to the Service.

2.2 Authority to pay

You confirm that you are authorised to use the payment method provided and that all account and billing information is accurate and complete.

3. Products, Services & Use of Animalia Chat
3.1 General

We aim to describe products and services accurately. However:

Colours, packaging, and visuals may vary slightly from images shown.

Product descriptions and Service features may be updated.

3.2 Animalia Chat is informational support, not veterinary care

Animalia Chat provides general pet-related information and guidance. It does not replace professional veterinary advice, diagnosis, or treatment.

If your pet is unwell, injured, or you suspect an emergency, contact a qualified veterinarian immediately.

You remain solely responsible for decisions made regarding your pet.

3.3 Availability & updates

We may modify, update, suspend, or discontinue parts of the Service to:

Improve performance and safety,

Add or remove features,

Comply with legal, security, or platform requirements.

We will make reasonable efforts to maintain availability, but the Service may occasionally be unavailable due to maintenance, updates, or third-party outages.

3.4 Prohibited use

You agree not to:

Misuse the Site or Service (e.g., attempt to hack, disrupt, or reverse engineer),

Use the Service for unlawful purposes,

Provide harmful, abusive, or infringing content,

Attempt to scrape, copy, or exploit the Service at scale without permission.

We may suspend or terminate access if we reasonably believe there has been misuse.

4. Ownership of Content & Intellectual Property
4.1 Our intellectual property

All content on the Site and within the Service—including text, logos, branding, product descriptions, design elements, software, and compiled content—is owned by or licensed to PetCareAI LTD and protected by intellectual property laws.

4.2 Limited licence

We grant you a limited, non-exclusive, non-transferable licence to access and use the Site and Service for personal, non-commercial purposes, subject to these Terms.

4.3 Restrictions

You may not, without our prior written consent:

Copy, reproduce, distribute, modify, publish, or create derivative works,

Use our trademarks, branding, or assets,

Use content for commercial purposes.

4.4 User content

If you submit content (e.g., pet info, messages, feedback), you grant us a licence to use it to operate and improve the Service, subject to our Privacy Policy and applicable data protection law.

5. Prices, Taxes & Payment
5.1 Pricing

Prices are shown in the currency displayed on the Site. Prices may change at any time, but changes will not affect orders already confirmed.

5.2 Taxes & VAT

Depending on your location, prices may include or exclude VAT/sales tax and may be calculated at checkout. You are responsible for any applicable taxes, duties, or import fees where relevant.

5.3 Payment processing via Stripe

We use Stripe to process payments. By placing an order or subscribing, you authorise us (via Stripe) to:

Charge your payment method for purchases and recurring subscription fees,

Store payment method tokens for recurring billing (handled by Stripe),

Process refunds where applicable.

We do not store full card details on our servers. Stripe handles sensitive payment data in accordance with its security standards.

5.4 Payment failures

If a payment fails:

We may retry charging your payment method,

Access to the Service may be paused or restricted until payment is successfully processed,

You remain responsible for all outstanding amounts.

5.5 Fraud prevention & verification

We may perform security checks or request additional verification to prevent fraud. If verification cannot be completed, we may cancel the transaction.

6. Subscriptions, Free Trials & Automatic Renewal
6.1 Subscription services

Certain offerings include subscription access to Animalia Chat (“Subscription”). Subscription details (price, billing cycle, and included features) are displayed at checkout or within your account area.

6.2 Free trial activation

Where a free trial is offered:

The free trial activates upon purchase or sign-up (as stated at checkout),

Trial length and start date will be shown during checkout or in confirmation communications.

6.3 Automatic renewal (important)

Unless you cancel before the end of the free trial (or before the next renewal date), your Subscription will automatically renew and you will be charged the applicable subscription fee using your saved payment method via Stripe.

By completing your purchase/sign-up, you acknowledge and accept automatic renewal.

6.4 Managing and cancelling subscriptions

You can cancel at any time:

Through your account dashboard (if available), or

By contacting our support at: support@petcareai.uk

Cancellation takes effect at the end of the current billing period unless otherwise stated at checkout. You may retain access until the end of the paid period.

6.5 Refunds for subscriptions

Unless required by law or explicitly stated in a specific refund policy:

Subscription fees are generally non-refundable once a billing cycle has started.

If you cancel, you will not be charged for the next period.

If you believe you were charged in error, contact support promptly so we can investigate.

7. Delivery, Third-Party Providers & Delays
7.1 Third-party dependencies

We may rely on third-party providers such as:

Payment processors (Stripe),

Shipping carriers,

Laboratories (if applicable),

Hosting and infrastructure vendors,

Subcontracted service providers.

7.2 Delays and disruptions

We are not responsible for delays caused by events outside our reasonable control, including but not limited to:

Carrier delays, customs checks, strikes,

Laboratory processing times,

Weather disruptions,

Third-party outages, or

Regulatory requirements.

7.3 Risk & responsibility (physical goods)

If you purchase physical goods, risk of loss typically passes upon delivery to the address provided (subject to your local consumer rights). You are responsible for providing accurate delivery information.

8. Returns & Consumer Rights (summary)

Your legal rights depend on where you live and what you purchased.

8.1 UK consumers

If you are a UK consumer, you may have rights under UK consumer law, including the Consumer Rights Act 2015 and (for distance sales) the Consumer Contracts Regulations 2013.

8.2 Digital services

If you purchase digital content/services, your right to cancel may be affected once:

The digital service is delivered,
if you have agreed to immediate delivery/performance (as applicable).

9. Limitation of Liability

9.2 No liability for indirect loss

To the maximum extent permitted by law, we are not liable for:

Indirect, incidental, special, or consequential losses,

Loss of profits, business, goodwill, or data,
arising from use of the Site, products, or Service.

9.3 Service outcomes

You acknowledge that:

Animalia Chat outputs may not always be accurate, complete, or suitable for your specific situation.

You use the Service at your own risk.

You are responsible for verifying information with qualified professionals where appropriate (e.g., veterinarians).

9.4 Third-party services

We are not liable for failures or interruptions caused by third parties, including Stripe, hosting providers, carriers, customs, labs, or subcontractors, except where required by law.

10. Termination

We may suspend or terminate your access to the Site or Service if:

You breach these Terms,

We suspect fraud or misuse,

We must do so to comply with law or protect users/our systems.

Where possible, we will provide notice. Termination does not affect accrued rights or amounts owed.

11. Privacy & Data Protection

Your use of the Site and Service is also governed by our Privacy Policy (and, where applicable, Cookie Policy).
We process personal data in accordance with applicable UK data protection laws (including UK GDPR) and any other relevant regulations depending on your location.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction, except where mandatory consumer protection laws in your country of residence require otherwise.
